AA Tributes - Limited Terms of Service

1. Definition & General

Terms

In these Terms and Conditions the text ‘AA Tributes’, ‘Auld Acquaintance Tribute Videos’, ‘www.aatributes.co.uk‘, ‘we’, ‘us’, ‘our’ and ‘ours’ refer to Fortsunlight, a UK partnership. The words ‘Client’ and ‘Customer’ refer to the party who commissioned and/or funded the work and any person or organisation acting on their behalf.
These Terms and Conditions apply to all video and associated audio product created by AA Tributes, including all moving and still images and sound recordings of whatever form.

By accessing the website at www.aatributes.co.uk, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.

2. Disclaimer

1. The materials on AA Tributes website are provided on an ‘as is’ basis. AA Tributes makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

2. Further, AA Tributes does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

4. Limitations

In no event shall AA Tributes or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on AA Tributes website, even if AA Tributes or a AA Tributes authorised representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

5. Accuracy of Materials

The materials appearing on AA Tributes website could include technical, typographical, or photographic errors. AA Tributes does not warrant that any of the materials on its website are accurate, complete or current.

AA Tributes may make changes to the materials contained on its website at any time without notice. However, AA Tributes does not make any commitment to update the materials.

6. Links

AA Tributes has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by AA Tributes of the site. Use of any such linked website is at the user’s own risk.

7. Modifications

AA Tributes may revise these terms of service for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these terms of service.

8. Booking and Payment

Payment in full is required prior to downloading the finished tribute film. This is actioned via the WeTransfer.com file transfer system. 

9. Cancellation & Termination

We can withdraw, cancel or amend the proposal if it has not been accepted by you, or if the project has not started, within a period of 30 days from the date of the quotation, (unless the quotation has been withdrawn).

Either we or you can cancel the order for any reason prior to your acceptance (or rejection) of the quotation.

If you want to amend any details of the project you must tell us in writing as soon as possible. We will use reasonable endeavours to make any required changes and additional costs will be included in the fees and invoiced to you.

If due to circumstances beyond our control, including those set out in the clause below, we have to make any change in the project or how they are provided, we will notify you immediately. We will use reasonable endeavours to keep any changes to a minimum.

10. Refunds

In the unlikely event, you are unhappy with the completed tribute film due to circumstances that are under our control, AA tributes will offer a full refund.

However, we cannot be held responsible for the quality of the photographs and/or videos provided by the client. On rare occasions where there is joint responsibility an amount of the fee will be refunded, and the decision to provide them, are at AA tributes sole and absolute discretion, and the provision of a refund in one instance does not entitle anyone to a refund in the future under similar or different circumstances.

11. Licensing

AA tributes holds a subscription with the Audiio.com music library service. All the music used in our films (unless provided by the client or otherwise stated) is owned by Audiio LLC and the artists they represent.  The licence provided by Audiio.com grants us global use in perpetuity.

12. Use of tribute films

As our client, you have the right to use/share your video as you see fit. Otherwise, we retain full rights to the videos we create and these videos are not to be used by 3rd parties. Tribute films are very personal and we will only ever use full videos (or clips) in the promotion of our services with the agreement of our client. The video(s) created will, unless otherwise arranged, be available for at least 3 months, after which period they will be deleted (along with the original assets).

13. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of United Kingdom and you irrevocably submit to the exclusive jurisdiction of the courts in that location.
